Duty to verify article 2.30 sub c Working Conditions Act
The duty to verify means that a client must actively check whether the contractor has taken sufficient measures to carry out the work safely and healthily. It is therefore not an optional responsibility. The duty to verify does not apply if the work is carried out under the management and supervision of the client. In that case, there is a relationship of authority and the person is legally an employee. All Arbo obligations are then already in force. The duty to verify is not an obligation to fully control or supervise at all times, but to a reasonable degree of care in advance. Every employer AND client is therefore legally obliged to draw up a V&G plan and RI&E. We draw up the V&G plan and RI&E in accordance with the legal requirements and adapt it to the nature of your work.
Do you already have a RI&E, but are you not sure whether it is still up to date or complete? We perform a thorough assessment.
Do you want to certify your company or prepare for an audit within the Safety Culture Ladder? We guide you and your company.
Whether it concerns questions from the Labour Inspectorate, drawing up policy, preventive measures or fulfilling the role of prevention officer, we are here for you. My Arbo has listed the legal substantiation of these legal obligations for you.
